Travelocity PriceGuardianSM for Packages
Terms and Conditions:
1. Travelocity PriceGuardian is available to any customer who books a qualifying Flight+Hotel Vacation Package through the Travelocity.com Web site. To be a qualifying booking, a Flight + Hotel Vacation Package must be made on Travelocity.com from March 16, 2009 through December 31, 2009, and satisfy the requirements of these Terms and Conditions.
2. Travelocity PriceGuardian applies only to Flight+Hotel Vacation Packages booked on Travelocity.com, using a valid credit card with a United States billing address. Subject to these Terms and Conditions, if another Travelocity customer books the same Flight + Hotel Vacation Package at a lower price after you book, we'll automatically refund the difference to you.
3. If another Travelocity.com customer books the same Flight+Hotel Vacation Package that you booked, meaning their Vacation Package contains the same flight and hotel combination (the same dates/times of travel, on the same airline/s, with the same flight numbers, for the same passenger type, itinerary, cabin, and subject to the same fare refundability, or other restrictions, and the same hotel and room type), and the price they pay is at least $10 lower than the price you booked, then Travelocity will refund the difference to you, up to a maximum of $500 per package. We will monitor the price you paid and the price paid by our other customers beginning after you book, until the day you fly. If more than one customer books a lower priced Vacation Package, you will only get one refund based on the lowest price booked.
4. Travelocity PriceGuardian applies only to the total Flight + Hotel Vacation Package price (including base price, taxes, government fees, and airline or hotel imposed fuel and other surcharges) and does not apply to differences based on processing, shipping, paper-ticket, insurance and other fees and charges not collected in the Vacation Package price. We will not consider the price paid for Activities or travel protection when comparing your Vacation Package to the Vacation Packages booked by our other customers. We will not consider promo codes used by our other customers to reduce the price they paid on a Vacation Package.
5. Travelocity PriceGuardian does not apply to lower prices for packages that are available on other Web sites or travel channels, to package itineraries you cancel or change, or to itineraries booked before you made your booking. Travelocity PriceGuardian applies only to Flight + Hotel Vacation Packages, and does not apply to Car + Hotel Vacation Packages, Escorted Vacations, Last Minute Packages, and individual flight and hotel stays not sold as part of a Flight + Hotel Vacation Package.
6. If the airline or hotel refunds your flight or hotel stay, Travelocity PriceGuardian will not apply. Fare decreases resulting from changes to an air carrier's fare filing policies or practices will not be eligible for Travelocity PriceGuardian.
7. Travelocity reserves the right, in our sole discretion, to deny any claims that we suspect or deem to be fraudulent.
8. Travelocity reserves the right, in our sole discretion, to modify, suspend, or terminate Travelocity PriceGuardian for Vacation Package itineraries booked on any air carrier or hotelier which files for or becomes the subject of any bankruptcy proceeding, or becomes part of, or subject to a merger, acquisition, or other change in entity status, or ceases operations.
9. Travelocity PriceGuardian will not apply in the event of natural catastrophes, acts of terrorism, third party errors, technical failures, software or system malfunctions, governmental acts, transportation stoppages or slowdowns, or other events beyond Travelocity's control.
Refund Processing
1. Upon verification by Travelocity that you are eligible for a refund under the Travelocity PriceGuardian program, Travelocity will send you an e-mail notice to the e-mail address listed under "My Account" in "My Stuff" on the Travelocity.com site, which will include the amount of the refund you may be entitled to.
2. You can expect to receive your refund on the credit card used to book the qualifying Vacation Package within 30 days after you complete all travel components in a qualifying Vacation Package.
3. The refund will only be issued to the Travelocity member account under which the qualifying Vacation Package booking was made, and the refund will be applied to the original form of payment used to pay for the qualifying Vacation Package.
4. The credit card refund is the sole and exclusive compensation that will be provided to you under the Travelocity PriceGuardian program. Travelocity will not pay cash or any other compensation for refunds that may be due under the Travelocity PriceGuardian program.
5. If the credit card you used to book the qualifying Vacation Package is canceled, expired or otherwise void or invalid, Travelocity will be unable to send you a refund.
Void where prohibited by law. Travelocity reserves the right in its sole discretion to modify or discontinue the Travelocity PriceGuardian program or to restrict its availability to any person, at any time, for any reason, and without prior notice or liability to you. Travelocity's failure to enforce any provision of these Terms and Conditions shall not constitute a waiver of that provision. The terms contained in the Travelocity User Agreement are incorporated and made a part of these Terms and Conditions. Any modification will be effective upon posting of modified Travelocity PriceGuardian Terms and Conditions on the Travelocity.com web site. Any cancellation will be effective upon removal of references to the Travelocity PriceGuardian Program and the Travelocity PriceGuardian Terms and Conditions from the Travelocity.com web site.
