  1. ELIGIBILITY: The Sexy Sultry Sweepstakes (“Sweepstakes”) is open only to legal residents of the 48 contiguous United States and the District of Columbia (excluding Rhode Island); 21 years or older at the time of entry. Proof of residency and age may be required. Employees, officers, directors and representatives of Travelocity.com LP (“Sponsor”) and each of its respective parent companies, subsidiaries, affiliates, co-sponsors, divisions, their respective advertising and promotion agencies and immediate family members and household members of each of the above are ineligible to enter or win a prize. “Immediate family members” shall mean spouse, parents, step-parents, legal guardians, children, step-children, siblings and step-siblings and each of their respective spouses. “Household members” shall mean those people who share the same residence at least three months a year. Void in Rhode Island and where prohibited by law. Void outside of the 48 contiguous United States, and the District of Columbia. All federal, state, and local laws apply.

    The Sweepstakes entry period begins at 12:01 AM Central Time (“C.T.”) on Sunday, 03/01/09 and ends at 11:59 PM C.T. on Wednesday, 04/01/09 (“Sweepstakes Period”). Here is how to enter:

    http://leisure.travelocity.com/Promotions/1,,TRAVELOCITY|5276|sweeps_main|,,00.html (the “Site”) during the Sweepstakes Period and complete the Official On-line Entry Form by providing the following information: first and last name, street address, city, state of residence, zip code, age, e-mail address and phone number. You need not enroll as a member of Travelocity.com in order to submit an entry.

    Limit one entry (regardless of method of entry) per person. All entries in excess of this limit will be disqualified and ineligible for the Sweepstakes. Each entry must be submitted separately. Limit one (1) person per e-mail address. All entries generated by a script, macro or other automated/repetitive electronic means will be disqualified and ineligible for the Sweepstakes. Sponsor not responsible for lost, illegible, incomplete, mutilated or stolen entries; errors appearing on the entry form, within these Official Rules, in any Sweepstakes related advertisements or other materials; or other errors of any kind whether mechanical, human, electronic or otherwise. Entries that are late, illegible, incomplete, unreadable, damaged, delayed, lost, tampered with, incomprehensible, forged, mutilated, misdirected, inaccurate, unintelligible or otherwise not in compliance with these Official Rules will be disqualified. All requested information on the entry form must be completed in English to enter and be eligible. By entering the Sweepstakes, each entrant hereby agrees that Sponsor may use the personal information collected from entrant for the purpose of administering the Sweepstakes, fulfilling prizes (if applicable), and providing entrant with information relating to Sponsor or its affiliates and each of their, respective products, services and promotions. Sponsor will not sell, share or otherwise disclose an entrant’s personal information to a third party, other than to those engaged by Sponsor to fulfill the above purposes, without the entrant’s permission. All entries become the property of Sponsor and will not be returned.
  3. PRIZE DETAILS:

    Grand Prize Winner will receive:

    • Roundtrip coach-class air transportation for two (2) from a major metropolitan airport near winner’s permanent residence at the time of entry to Oranjestad, Aruba on an airline designated by Sponsor.
    • Four (4) nights’ double-occupancy hotel accommodations at Renaissance Aruba Resort and Casino in Orangestad, Aruba.


    TOTAL APPROXIMATE RETAIL VALUE: US$4,900. Actual value of the prize may vary based on airfare fluctuations and distance between departure location and destination. Winner will coordinate with Sponsor's representative to book such trip within the requisite timeframe. Prizes may not be exchanged. Prize will not be replaced if lost, stolen or expire prior to use (unless restricted by law). Unless expressly indicated, all expenses associated with a prize or the uses of a prize are not included and will be the sole responsibility of winner. Limit one prize per person per household. No transfer or substitution of prize permitted by winners. Sponsor may substitute a prize of equal or greater retail value if prize is unavailable or cannot be awarded for any reason. Prize may not be redeemed or exchanged for cash. Prize not combinable with any other offers. All prizes properly claimed will be awarded. All applicable federal, state, and local tax laws apply. The Internal Revenue Service (“IRS”) requires Form 1099-MISC to be issued and filed with the IRS for each recipient of a prize who is a resident of the United States if the value of that prize is at least $600. Reporting and payment of any applicable federal, state, and local taxes is the sole responsibility of prize winner.
  4. PRIZE RESTRICTIONS:

    All travel plans for winner and any guest(s) must be made at one (1) time through Travelocity.com, within ninety (90) days of accepting the prize. Travel dates are subject to availability and holiday/blackout dates, conventions and special event periods, must include a Saturday-night stay, and must be completed by 04/01/2010. No extensions will be permitted. All travel requests will be fulfilled based on availability. Guest of winner must be 21 or older. If winner is unable to travel by date indicated, prize will be forfeited, and an alternate winner may be selected in accordance with these Official Rules from among the remaining eligible entries for that prize. Prizes may not be transferred or assigned except by Sponsor. Winner must meet the designated car rental company’s requirements in order to receive the car rental portion of the prize, if any.

    If prize includes international travel, customs and immigration require certain documents to travel to foreign country; it is the winner’s sole responsibility for winner and any guest to travel with the required documents. No refunds will be made if improper documentation or failure to comply with any of the rules and regulations of the travel provider results in denied boarding or entry, and prize will be forfeited. Unless otherwise designated, all air travel will be provided by an airline designated by Travelocity.com. Prizes, reservations, and airline (or cruise) tickets are non-refundable, non-transferable, non-changeable once issued, and may not be used in conjunction with any other competition or offer. No refunds or credit changes are allowed. If tickets are lost, stolen or expire prior to use (unless restricted by law), they will not be replaced. Credit for previous purchases is not permitted. All tickets are subject to the vagaries of flight variation, work stoppages, and schedule or route changes.
  5. GENERAL WINNER SELECTION:

    Winner will be selected in a random drawing from all eligible entries received during the Sweepstakes Period. Drawing will be held by Sponsor, on or about 04/03/09. All decisions in all matters relating to this Sweepstakes made by Sponsor are final. Odds of winning depend solely on the total number of valid entries received during the Sweepstakes Period.

    Winner will be notified by e-mail and/or telephone promptly following drawing. Winner will be sent (via facsimile and/or other method determined in the sole discretion of Sponsor) an affidavit of eligibility together with liability/publicity release (“Affidavit and Release”). Winner must complete and return (as directed by Sponsor) the Affidavit and Release unless restricted by law, which must be received by Sponsor no later than seven (7) business days after the Affidavit and Release is sent to that winner (or other time as determined in the sole discretion of Sponsor) or, in Sponsor’s sole discretion, prize may be forfeited and an alternate winner may be selected in accordance with these Official Rules from among the remaining eligible entries for that prize. Additionally, all guests of winner must complete, sign and return a Travel Companion Liability Release, and where permitted by law, a Publicity Release prior to issuance of travel documents. If any guest is a minor, minor must have a parent or legal guardian sign the documents on the minor’s behalf and the minor must be accompanied by such parent or legal guardian. Sponsor shall have no liability for any winner notification that is lost, intercepted or not received by the potential winner for any reason. In Sponsor’s sole discretion, a potential winner may be disqualified and required to forfeit the prize, and an alternate winner may be selected in accordance with these Official Rules from among the remaining eligible entries for that prize, if (1) potential winner does not respond to a notification email or phone call (with all requested information) within the required time; (2) an email notification is returned as undeliverable after three (3) attempts; (3) the failure of a potential winner to complete, sign, notarize and return required Affidavit and Release and/or Travel Companion Liability Release (and any other documents, if requested) within the required time; (4) any prize notification/documentation/prize returned as undeliverable for any reason; (5) a potential winner is ineligible or cannot be notified or contacted; (6) a potential winner's inability to provide Sponsor with satisfactory proof that he/she is the authorized account holder of the email address associated with the winning entry (if requested); (7) failure to respond to any other required time periods; (8) any other non-compliance with these Official Rules. Proof of response by a potential winner does not constitute proof of receipt by Sponsor. Forfeited prizes may not be awarded. Sponsor not obligated to leave voice mail, answering machine or other message. Before a winner is entitled to receive a prize, such winner is required to provide Sponsor with a valid, properly completed and executed IRS Form W-9 (in addition to any other requested information) for tax purposes as well as a valid government issued photo identification card. Sponsor reserves the right to modify the notification and affidavit/release procedures in connection with the selection of alternate winners, if any.
  6. GENERAL CONDITIONS AND LIMITATION OF LIABILITY:

    By participating in this Sweepstakes, each entrant agrees to be bound by these Official Rules and the decisions of the Sponsor, which are final and binding in all respects and cannot be appealed. By entering, each entrant agrees and acknowledges that Sponsor and its parent company, affiliates, divisions, subsidiaries and advertising and promotions agencies, and each of their respective employees, officers, shareholders, representatives, directors and agents (collectively, “Releasees”) are not responsible for and shall not be liable for: (i) late, lost, delayed, misdirected, mutilated, incomplete, unreadable, inaccurate, garbled or unintelligible entries; (ii) telephone system, facsimile, technical or computer malfunctions, lost connections, disconnections or transmission or other errors of any kind whether mechanical, human, electronic or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors which may occur in connection with the administration of the Sweepstakes or the processing of entries; (iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iv) any injuries, losses, costs, expenses or damages to person or property of any kind caused, in whole or in part, directly or indirectly, by the prize or resulting from redemption, acceptance, possession, loss or use or misuse of any prize or from participating in the Sweepstakes or any Sweepstakes related activity; or (v) any printing, typographical, administrative, human or technological errors in any material associated with the Sweepstakes. Releasees have not made and/or are not responsible for any misrepresentation or guaranty, express or implied, in fact or in law, relative to the prizes.

    BY ENTERING THE SWEEPSTAKES, ENTRANTS AGREE THAT: (1) ANY AND ALL DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE SWEEPSTAKES, OR ANY PRIZES AWARDED, SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (2) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT OF POCKET COSTS INCURRED NOT TO EXCEED ONE HUNDRED DOLLARS ($100.00), INCLUDING COSTS ASSOCIATED WITH ENTERING THE SWEEPSTAKES, BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (3) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, DIRECT, INDIRECT, INCIDENTAL AND/OR CONSEQUENTIAL DAMAGES AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES, AND/OR ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED. IN NO EVENT WILL RELEASEES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, ARISING OUT OF ENTRANT’S ACCESS TO, USE OF, OR DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM WWW.TRAVELOCITY.COM OR ANY OTHER WEB SITE ASSOCIATED WITH THIS SWEEPSTAKES. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON SAID WEB SITE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. LIMITATIONS OR EXCLUSIONS OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES AND/OR EXCLUSIONS OF IMPLIED WARRANTIES SUBJECT TO ALL APPLICABLE FEDERAL, STATE AND LOCAL LAWS AND REGULATIONS.

    Sponsor reserves the right, in its sole discretion, to modify, cancel or suspend this Sweepstakes (or any portion of the Sweepstakes) should an error, virus, bug, computer problem or other cause or problem corrupt or inhibit the administration, security or proper operation of the Sweepstakes and, in such situation, to select the winner(s) from the eligible, non-suspect entries received prior to and/or after the such action or in such manner as deemed fair and appropriate by Sponsor. Sponsor may prohibit participant from participating in the Sweepstakes or winning a prize if, in its sole discretion, it determines participant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair practices or intending to annoy, abuse, threaten or harass any other participants or Sponsor’s representatives. The interpretation of these Official Rules shall be governed by the laws of the United States and the State of Texas, without regard to its conflict of laws principles. Any disputes arising under, or related to, the Sweepstakes must be brought in the federal and state courts located in Tarrant County, Texas.

    CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH ENTRANT OR ANY OTHER INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION.

    By entering the Sweepstakes, each entrant agrees and acknowledges that Releasees and any of their designees may, without any limitation or further compensation, use his or her name, voice, biographical data and/or likeness in any and all media now known or hereinafter devised, throughout the universe and in perpetuity, for the purpose of advertising and promoting the Sweepstakes or any other promotion, contest or sweepstakes sponsored by Sponsor, except where prohibited by law. For example, each entrant understands and agrees that if he/she is selected as a potential winner, such entrant’s name, city and state may be announced at www.travelocity.com and elsewhere.
